Byelaws

As to Parks, Open Spaces and Recreation Grounds

BYELAWS made by The Mayor and Burgesses of the London Borough of Bexley, acting by the Council, under section 164 of the Public Health Act 1875, section 15 of the Open Spaces Act 1906 and sections 12 and 15 of the Open Spaces Act 1906 for the regulation of pleasure grounds and open spaces.

Obstruction or disturbance of officers

22.

A person shall not in the pleasure ground intentionally obstruct, disturb, or annoy any other person in the proper use of the pleasure ground, or intentionally obstruct, disturb any officer of the Council in the proper execution of his duty, or any person or servant of any person employed by the Council in the proper execution of any work in connection with the laying out of maintenance of the pleasure ground.

Penalty

23.

Every person who shall offend against any of these byelaws shall be liable on summary conviction to a fine not exceeding one hundred pounds.

Removal of offenders from the ground

24.

Every person who shall infringe any byelaw for the regulation of the pleasure ground may be removed therefrom by any officer of the Council, or by any constable, in any of the several cases hereinafter specified, that is to say:

  1. Where the infraction of the byelaw is committed within the view of such officer or constable, and the name and residence of the person infringing the byelaw are unknown to and cannot be readily ascertained by such officer or constable;
  2. Where the infraction of the byelaw is committed within the view of such officer or constable and from the nature of such infraction, or from any other fact of which such officer or constable may have knowledge, or of which he may be credibly informed, there may be reasonable ground for belief that the continuance in the pleasure ground of the person infringing the byelaw may result in another infraction of a byelaw, or that the removal of such person from the pleasure ground is otherwise necessary as a security for the proper use and regulation thereof.

Revocation of byelaws

25.

The following byelaws are hereby revoked:

  1. Byelaws with respect to pleasure grounds made by the Urban District Council of Erith on the fourteenth day of January 1936 and confirmed by the Minister of Health on the fourth day of February 1936 as amended by the byelaws made on the seventeenth day of June 1940 and the first day of July 1950 and confirmed by the Minister of Health and Secretary of State on the nineteenth day of August, 1940 and the eighth day of September 1950.
  2. Byelaws with respect to pleasure grounds made by the Urban District Council of Crayford on the twenty eighth day of April 1948 and confirmed by the Secretary of Sate on the eighth day of June 1948.
  3. Byelaws with respect to pleasure grounds made by the Corporation of Bexley on the thirty first day of January 1939 and confirmed by the Minister of Health on the ninth day of March 1939 as amended by a byelaw made by the said Corporation on the fifteenth day of January 1959 and confirmed by the Secretary of State on the third of March 1959.
  4. Byelaws with respect to pleasure grounds known as Sidcup (Longlands) Recreation Ground and Waring Park in the Urban District of Sidcup and made by the Urban District Council of Sidcup on the twentieth day of January 1932 and confirmed by the Minister of Health on the thirtieth day of March 1932.
  5. Byelaws with respect to pleasure grounds and open spaces made by the Urban District Council of Chislehurst and Sidcup on the third day of August 1963 and confirmed by the Secretary of Sate on the second day of October 1963.
