Draft Planning Obligations Guidance

Introduction

Planning obligations are agreements between local councils and developers to make sure new development contributes towards the provision of local infrastructure, services and facilities. For more information see About Planning Obligations.

Making Comments

We would like your views on the draft Guidance. Comments must be made by Monday, 19 May. You can make comments:

  • by e-mail to ldfteam@bexley.gov.uk
  • in writing to LDF Team, London Borough of Bexley, Wyncham House, 207 Longlands Road, Sidcup, Kent, DA15 7JH

Representations will be open to public inspection and may be quoted in reports prepared for Councillors. Representations may include a request to be notified when the Council has adopted the final version of the Guidance. Copies of the final version will be available on request (for a small charge).

What Happens Next?

The Council will consider all comments received during the consultation period during the preparation of the final version. We anticipate that the Council will adopt the final version in July 2008.

The adopted Guidance will be a Supplementary Planning Document (SPD), forming part of the Local Development Framework (LDF). For further information see About Bexley’s Planning Obligations Guidance below. The SPD will then be subject to monitoring and review.

About Planning Obligations

A planning obligation is a legal agreement made between a local planning authority and a developer where it is necessary for the developer to provide contributions to offset negative impacts caused by the development. These contributions might include affordable new homes, new open space, school places, employment training schemes, or health and sports facilities. The developer will either provide these facilities directly or make payments to the Council for them to be provided. Contributions may be required before the local planning authority grants planning permission.

Planning obligation agreements must be relevant to the development to which they relate. They may be provided on the development site or off-site.

Planning obligations are also known as “Section 106 Agreements” or “S106 Agreements”, after the section of the Act of Parliament they appeared in.

About Bexley’s Planning Obligations Guidance

The Council’s policy on planning obligations is set out in saved policies in the Unitary Development Plan (UDP). The draft Planning Obligations Guidance provides further guidance on what the London Borough of Bexley will seek in planning obligation agreements and in what circumstances they will be required.

When adopted, Bexley’s Planning Obligations Guidance will provide clear policy guidance for anyone involved in the planning process and guide negotiations between the Council and potential developers submitting planning applications on planning obligations.

The adopted Guidance will be a Supplementary Planning Document (SPD), forming part of the Local Development Framework (LDF). SPDs give further detailed guidance on the Council's planning policies set out in the UDP and LDF. You can view more information about the UDP and LDF here.

Developing the Draft Guidance

Consultants appointed by the Council have prepared the draft Guidance. They consulted various service providers, on the Council’s behalf, for example, the Bexley Care Trust on health provision.

The draft Guidance reflects recent changes in Government guidance and in the External LinkLondon Plan (February 2008), as well as policies in Bexley’s Unitary Development Plan (UDP) and Local Development Framework.

The draft Guidance has also been subject to a sustainability appraisal. This appraisal identified how sustainability issues have been taken into account and what the likely impacts will be. The supporting sustainability appraisal report and appendices are available here:

Some financial viability and testing work has been carried out to ensure the level of contributions set will not undermine the viability of, or reduce the submission of, development proposals.
