Licensing
& Registrations
List of licenses
The Public Protection department deals with the following types
of 'licences':
(*) Copies of these licences etc should generally be on public
display at the premises to which they relate. If you don't see one
ask "why?" and try to find somewhere that is licensed.
(A) Applications for new licences or where there are substantial
changes to an existing license must be advertised in order that
residents can be given the opportunity to object to the application
and appear before the Licensing Applications Panel. In all other
cases there is no requirement for public advertisement.

Animal Boarding Establishments
Licence [i.e. kennels, catteries, and pet sitters]
- Anyone who looks after someone else's cat or dog other than
at the owner's home needs a licence. Purpose built catteries and
kennels, and anyone looking after your animal in their home as
part of a business should therefore be licensed.
- The purpose of the licence is to ensure the health and welfare
of the animals, their security, and the avoidance of nuisance
to neighbours.

Authorisation under Environmental
Protection Act
- A range of commercial and industrial premises capable of emitting
significant amounts of pollution ("prescribed processes")
have, for many years, been required to be authorised under the
Environmental Protection Act. The responsibility for regulating
these processes is split between the Council and the Environment
Agency. The majority of processes covered by this Act within the
Bexley borough area only have significant emissions to air, and
are regulated by the Council.
- Part of the philosophy behind regulation under the Environmental
Protection Act has included improving public access to information
about industrial processes and their emissions. A public register
containing information about prescribed processes within the borough
is available for inspection free of charge at the offices of the
Environmental Health & Trading Standards service at 2a Hadlow
Road, Sidcup, during normal office hours. The Council also keeps
copies of documents on behalf of the Environment Agency on the
public register.

- Authorisations under the Environmental Protection Act are starting
to be phased out and to be replaced by permits under the Pollution
Prevention and Control Act. Similar in many ways to authorisations,
permits can be more onerous in their requirements than authorisations,
especially for the more complex/polluting processes.

Chimney Height Approvals
- The Clean Air Act 1993 requires the heights of certain chimneys
to be approved. Installations in 'normal' domestic premises would
not normally need approval. Those requiring approval are those
serving furnaces, boilers of similar appliances that:
- Burn pulverized fuel;
- Burn, at a rate of 45.4 kg or more per hour, any other solid
matter, or;
- Burn at a rate equivalent to 366.4 kW or more, any liquid
or gaseous matter
- Due to the size of these furnaces this is only likely to apply
to industrial or commercial premises.

permission for example) that may also be required, and also applies
to replacements as well as to new installations.

Cooling Towers, etc. Notification
- Anyone operating a wet cooling tower or an evaporative condenser,
whether for air conditioning or process control or other reasons
is required to notify the local authority that they have this
equipment. The purpose of this is to help prevent the spread of
legionnaires disease if an outbreak should occur.

Dangerous Wild Animal Licence
- Persons wishing to keep a dangerous wild animal must first obtain
a licence from the local authority.
- Animals Covered by the Dangerous Wild Animals Act 1976 include:
- Mammals
- Marsupials - Tasmanian devil, Grey
Kangaroo, Red Kangaroo, Wallaroo, Euro
- Primates - Tamarins, New World Monkeys
(Capuchin, Howler,Saki, Spider, Squirrel, Titi, Uakari,
Woolly and the Night Monkey), Old World Monkeys (Baboons,
Drill, Colobus Monkeys, Gelada, Guenons, Langurs, Leaf
Monkeys, Macaques, Mandrill, Mangebeys, Patas Monkey,
Proboscis Monkey and Talapoin), Leaping Lemurs (Indri,
Sifakas and Woolly lemur), Large Lemurs (except the Broad-nosed
and Grey Gentle Lemurs), Anthropoid Apes (Chimpanzees,
Gibbons, Gorilla, Orang-utan).

Explosives
- The manufacture or storage of explosives may require a licence or registration. A summary and guidance on the Manufacture and storage of Explosives regulations 2005 is available on the HSE website. In addition if you intend to sell fireworks outside of prescribed times you may need a separate licence - see below.
- If you wish to manufacture explosives, you will need to obtain a licence from the Health and Safety Executive.
- If you wish to store fireworks you are, subject to certain exemptions, required to register with Bexley Council.

Fireworks
- If you intend to sell fireworks other than during the following
periods you will require a licence under the Firework Regulations
2004:

Food Premises Registration
- All food businesses [i.e. Those who use premises for storing,
selling, distributing or preparing food, for more than 5 days
in any 5 consecutive weeks] must complete a registration form
and send it to the local authority at least 28 days before opening.
Changes to details must also be notified.

Game Dealers Licence
- Persons wishing to deal in or sell "game" [e.g. hares,
pheasants, partridge, and grouse] must hold a game dealers licence
available from the local authority. Game dealers must then obtain
an excise licence from the Post Office. All licences expire on
30th June each year.

Performing Animals
- Anyone wishing to either train or exhibit an animal must be
registered with a local authority.
- Certificates of registration issued to trainers or exhibitors
of performing animals are sent to the Home Office. The Home Office
in turn are required by the Performing Animals Rules 1925 to make
copies of certificates available for public inspection.

Permits under the Pollution Prevention
and Control Act
- The Pollution Prevention and Control Act applies a system of
integrated pollution prevention and control to a range of commercial
and industrial installations, and permits under this regime are
being phased in over the next few years to replace authorisations
granted under the Environmental Protection Act. The aim of the
regime is to achieve: "a high level of protection of the
environment taken as a whole by, in particular, preventing or,
where that is not practicable, reducing emissions into the air,
water and land".
- An application for a permit will need to show that a range of
environmental issues has been covered. The application must also
be advertised in the local press so that those interested in the
application have the opportunity to comment on it. Once a permit
has been issued, the operator has to carry out monitoring to demonstrate
that they are complying with the conditions attached to the permit.
Regulators can also carry out their own monitoring and inspections,
and have a range of enforcement powers. As with the Environmental
Protection Act, the majority of installations covered by this
Act within the Bexley Council area only have significant emissions
to air, and are regulated by the Council.

within the borough is available for inspection free of charge
at the offices of the Public Protection Service at 2a Hadlow Road,
Sidcup, during normal office hours. The Council also keeps copies
of documents on behalf of the Environment Agency on the public
register.

Pet Shops Licence
- Anyone selling pet animals must hold a licence from the local
authority. Pet animals include any vertebrate animals - fish,
amphibian, reptile, bird or mammal.
- Pet animals may only be sold from permanent premises. They cannot
be sold from a stall in a market for instance.
- The sale of pet animals can give rise to great public feeling
and concern. For this reason we place great emphasis on high standards
for the conditions of the premises and animal welfare. Experience
has shown that the sale of dogs and cats gives rise to more problems
than with other types of animals and that fish, amphibians and
reptiles give rise to the least. We have therefore adopted a risk-based
scheme where we categorise pet shops according to the types of
animals that they care for and sell. Depending on the category
they will be inspected at least 1, 2, or 4 times per year. Different
fees are set for each category of pet shop.
- Category 1 - these sell only fish, amphibians and/or reptiles.
This category of pet shop is inspected annually.
- Category 2 - these can sell category 1 animals plus birds
and/or small mammals. These pet shops are inspected twice
per year.
- Category 3 - these can sell category 1 and 2 animals, plus
dogs and/or cats. These are inspected 4 times per year.

Poisons
- The local authority must register any persons that wish to sell
certain poisons for example certain kettle de-scalers and drain
cleaners containing ammonia, and weed killers, such as paraquat.
The sale of poisons is prohibited unless the seller is a retail
pharmacist or a person who has his name on the local authority's
list entitling him to sell poisons from the premises named. Pharmacists,
the only persons allowed to sell poisons listed in Part 1, are
required to keep a Poisons Book in which certain information relating
to each sale of a poison must be entered before delivery to the
purchaser.

Riding Establishments Licence
- Anyone letting out horses for hire, or providing riding tuition,
is required to hold a riding establishment licence.
- The Council's Veterinary Officer inspects these premises at
least annually. They may also be subject to separate inspections
by health and safety inspectors.

- The Greater London Council (General Powers) Act 1984 requires
any premises used for the holding of Auctions and other sales
by Competitive bidding to be registered with the Local Authority.

Special Treatment
- These are invasive treatments that may pose a hazard to public
health and safety from infection and/or physical injury. They
therefore require close control to ensure that adequate safeguards
are in place including knowledgeable practitioners, infection
control procedures, advice on post treatment care, waste disposal
and insurance in case things go wrong.
- Bexley Council controls these businesses through a registration
system introduced under the Local Government (Miscellaneous Provisions)
Act 1982. This authority has not adopted the licensing provisions
of the London Local Authorities Act 1991.
- Under the current scheme operated by Bexley Council the premises
where the treatments take place, and the persons carrying out
the individual treatments, must be registered. A registered person
may carryout treatments at any registered premises.

Sunday Trading Notification
- There is no longer a need for Large shops [ie. those of over
280 m2 public sales area] to provide prior notification
to the local authority of their intention to open on Sundays.
However they are still subject to a restriction on their hours
of opening. Large shops may only open on a Sunday for a maximum
period of 6 hours which must be between 10am and 6pm. They may
not open where the Sunday is Easter Day or Christmas Day.
