We know that arguments over trees, hedges and boundaries can get heated. It’s important that the first thing you do is speak calmly with your neighbour.

If you really have come to a stalemate, you can ask us to intervene – but we’ll ask to see evidence you tried to sort things out first.

The rules about hedges

Hedges can really improve the look of a community and are great for local wildlife. But choosing the wrong plants or letting them get out of control can cause problems.

You can complain if you think your neighbour’s hedge is spoiling your enjoyment of where you live, and all of these are true:

  • the hedge (or the section causing problems) is a line of two or more trees or shrubs
  • it’s evergreen or semi-evergreen (it keeps at least some live/green leaves all year round)
  • it’s more than 2 metres tall

How to complain about an overgrown tree or hedge

  • Put together your evidence. We need to know you’ve already tried to solve the problem yourself, so make a record of when you spoke with your neighbour, and what you both said. 
  • Download the complaint form* and the guide to filling it in.
  • Fill in the form and send it to us, with your supporting information and a fee of £550 (using the contact details on the form). You must also send a copy to your neighbour.

Antisocial Behaviour Act 2003 - Part 8

These guidance notes are to help you fill in the form to make a complaint about a neighbouring high hedge. Consideration of your complaint will be delayed if you do not complete the form properly or do not provide the information requested. If you are still unsure how to answer any of the questions, please contact Development Control on 020 8303 7777 or email developmentcontrol@bexley.gov.uk.

Who’s who/the parties

We need all these names and addresses because there are some documents that we are required, by law, to send to the owner and occupier of the land on which the hedge grows. These include our decision on the complaint.

  • Even if someone else is submitting the complaint on your behalf, it is important that we have your contact details. Tick the ‘Yes’ box if you prefer to be contacted by e-mail. We cannot send documents to you electronically unless you agree.
  • You need to complete this section only if the complainant does not live in the property affected by the hedge. We need this information because we will have to get in touch with the occupier to arrange to visit the property so that we can see for ourselves the effect of the hedge.
  • Complete this section if you are a professional adviser, relative, friend or other representatives. You will be our main contact on all matters relating to this complaint. We will direct all queries and correspondence to you. Please bear this in mind. If you tick the ‘Yes’ box, we will conduct all business relating to this complaint by e-mail. But we cannot send documents to you electronically unless you agree.
  • This will normally be the person you have talked to when you tried to agree on a solution to your hedge problems. If the site where the hedge is growing does not have a postal address, use the box to describe as clearly as possible where it is, e.g. ‘Land to the rear of 12 to 18 High Street’ or ‘Park adjoining Tower Road’. We need this information because we will have to contact these people for their comments and to arrange to visit the site where the hedge is growing.
  • If the owner of the land identified in 4 above, does not live there, please complete this section. The Council requires this information, as it will be necessary to contact these people to obtain their comments and to arrange to visit the site where the hedge is growing.

If you are in any doubt about who owns the property where the hedge is situated, you can check with the Land Registry. The relevant form (313) is on their website (www.gov.uk/government/organisations/land-registry) or can be obtained from the Local Office. The current fee for this service is [£4], if you know the full postal address of the property. Alternatively, Land Register Online (at www.landregisteronline.org.uk/) provides easy access to details of registered properties in England. Copies of title plans and registers held in electronic format can be downloaded in PDF format for [£8] each. The register includes ownership details.

Criteria for making a complaint

Who can complain?

You must be the owner or occupier of the property affected by a high hedge in order to make a formal complaint to the Council. If you do not own the property (e.g. because you are a tenant or a leaseholder), you can still make a complaint. But you should let the owner (e.g. landlord or management company) know what you are doing.

The property does not have to be wholly residential but must include separate living accommodation otherwise we cannot consider the complaint.

Grounds of the complaint

It will help if you provide as much information as you can but keep it factual. Remember that a copy of this form will be sent to the person who owns the property where the hedge is growing, and to the person who lives there if they are different people. Concentrate on the hedge and the disadvantages you experience because of its height. We cannot consider problems that are not connected with the height of the hedge. For example, if the roots of the hedge are pushing up a path. Nor can we consider things that are not directly about the hedge in question. For example, that other people keep their hedges trimmed to a lower height; or that the worry is making you ill.

Attempts to resolve the complaint

Please keep the descriptions brief but say how you made the approach (e.g. face to face, phone, letter) and what the result was.

Example 1

  • 12 March - saw neighbours [Mr Bloggs of 12 High Street] in their garden and asked if we could discuss hedge - Mr Bloggs not willing to discuss the matter.
  • 17 March - wrote to neighbours [Mr Bloggs of 12 High Street] to ask if we could discuss hedge - 2 weeks later no reply.
  • 3 April - saw neighbours [Mr Bloggs] again and told them that, if we couldn’t agree on a solution, we would make a formal complaint to Council. Left it for a couple of weeks then confirmed in writing that we would be going ahead with the complaint

Example 2

  • 12 March - phoned neighbour [Mr Bloggs of 12 High Street] to ask if we could discuss hedge.
  • 19 March - Neighbours [Mr Bloggs] came round. Saw the effect of the hedge for themselves. Sympathetic but unwilling to reduce the hedge as much as we wanted.
  • 2 April - wrote to ask if he would speak to a mediator.
  • 15 April - mediators visited. But still couldn’t find an answer we were both happy with.
  • 14 May - wrote to inform neighbours [Mr Bloggs] that we would be complaining to Council

Previous complaints to the Council

We only need to know about formal complaints, made under the high hedges Part of the Anti-social Behaviour Act 2003. You don’t need to tell us about telephone calls or other informal contact with the Council about your hedge problems.

Supporting documents

It is not necessary to send copies of all correspondence with your neighbour about the hedge - especially if the dispute is a long-running one. You need only provide evidence of your latest attempts to settle it (within the last four months). Please also provide a photo of the hedge.

When drawing your plan, please make sure that you:

  • mark and name surrounding roads.
  • sketch in buildings, including adjoining properties. Add house numbers or names.
  • mark clearly the position of the hedge and how far it extends.

If you are complaining about the hedge blocking light, please also show on your plan:

  • which way is north.
  • the position of windows that are affected by the hedge (e.g. whether they are located on the front, side or rear of the house).
  • relevant measurements (e.g. size of the garden, the distance between the hedge and any windows affected).

All measurements must be in metres (m).

If you have ticked the last box, please list these documents by date and title (e.g. January 2005 - surveyor’s report). This will help us to check that we have got everything. If you are submitting this form by email but will be posting supporting documents to us separately, put a reference number or title on them (e.g. hedge complaint, Joe Bloggs, 12 High Street) so that we can match them up with your complaint.

Sending the complaint

Please make sure you have ticked all the relevant boxes.

The fee for dealing with a High hedge complaint is £550. Cheques should be made payable to the London Borough of Bexley.

It is a requirement of the legislation that you send a copy of your completed complaint form to the owner/occupier of the property where the hedge is located at the same time that you send it to the Council.

We charge you because it takes time to thoroughly investigate the complaint and visit the property to take a look. We won’t refund you if we don’t agree with your complaint or can’t solve the problem. If we think you were making a complaint for wrong or frivolous reasons, we won’t investigate any further. We’ll keep a £50 admin charge and refund the rest of your fee.

How we investigate a complaint

  • We’ll invite everyone involved to give us their side of the story. We’ll send you copies of anything we get back.
  • We’ll visit the property and take notes of the size of the hedge and how it looks from different viewpoints including yours, your neighbours’ and the general public’s (if it’s somewhere they can see it). We don’t take sides but make a decision based on whether the hedge is affecting how you enjoy your property.
  • If we agree with you, we’ll send what’s called a ‘Remedial Notice’ to your neighbour, explaining what we want done and how long they have to do it. For example, we can ask them to trim back a hedge to a suitable height. But we can’t and won’t ask them to:
  • Make the hedge shorter than 2 metres
  • Remove the hedge
  • Do anything that would destroy the hedge
  • If either of you are unhappy with our decision, you can appeal to the Planning Inspectorate and we’ll explain how.
  • If your neighbour doesn’t do what we ask in the Remedial Notice, we can take them to magistrates’ court. If convicted, they could be fined up to £1,000. We can also carry out the work on their property without their permission.

The rules about trees

Some trees are protected. That means the tree can’t be cut down, uprooted, lopped, damaged or destroyed without our permission. If you remove or damage a protected tree you can be taken to magistrates’ court. And if convicted, you can be fined up to £20,000 for each tree affected, as well as having to replace them.

Trees are protected if:

  • they’re under a Tree Protection Order (TPO)
  • they’re in a conservation area
  • keeping them is one of the conditions for planning permission we’ve granted

You can ask us to consider protecting a tree. And you can sponsor planting a new tree in your area to help keep Bexley beautiful.

Tree Protection Orders

A TPO is a legal document that means we control what happens to a tree. That could be an individual tree, a group, an area or a woodland.

We can’t use TPOs for hedges, shrubs or bushes (but we can put a TPO on a tree if it’s in a hedgerow). And we can’t use them for trees grown for food, like fruit trees.

If there’s a tree you think contributes to everyone’s enjoyment of the area, you or your local Councillor can ask us to consider putting it under a TPO. Or we might do that if someone’s made a development proposal, and we think keeping the trees in place is important. Email the Head of Development Management at developmentcontrol@bexley.gov.uk with TPO requests.

Conservation areas

We have 23 conservation areas in Bexley, which protect both the buildings and the trees. That means you have to give us six weeks’ written notice if you want to change anything about the trees (under Section 211 of the Town and Country Planning Act 1990).

You need to tell us in detail what you plan to do, and we recommend you speak to a tree surgeon before you get in touch. You can’t do anything to the trees until we’ve had a chance to look into it. Then we’ll let you know whether you can go ahead or if we’re putting the tree under a Tree Protection Order.

The only exceptions are:

  • if the tree is dead, dying or dangerous
  • if the tree’s stem, measured at 1.5m off the ground, is no thicker than 75mm round (measured over the bark).
