4. Key legislation

  • Crime and Disorder Act 1998. This Act gave BCSP partners the statutory responsibility to reduce crime and disorder in the Bexley local authority area
  • The Police and Justice Act 2006 extended this duty to cover ASB and substance misuse
  • The Policing and Crime Act 2009 to cover reduced reoffending
  • Anti-Social Behaviour, Crime and Policing Act 2014. This Act increased the tools and powers that BCSP partners can use to enforce against ASB; and ASB Case Reviews (formerly Community Triggers)
  • Counter Terrorism and Security Act 2015. This places the duty on public authorities to have due regard to prevention of terrorism in it’s functions; and to have a Board coordinating Prevent activity and a Channel Panel
  • Police Crime Sentencing Courts Act 2022. This established the Serious Violence Duty to include Serious Violence and Domestic Abuse within our Strategy and Action Plans; and carry out homicide reviews where an offensive weapon is used
  • Serious Crime Act 2015. Expanded obligations around combatting serious organised crime
  • Children’s Act 1989; and Care Act 2014. Key safeguarding legislations requiring certain reporting, referral and decision making mechanisms for the purpose of child and adult safeguarding by partnerships be in place
  • Domestic Violence, Crime and Victims Act 2004; Domestic Abuse Act 2021. This Act gave the BCSP the requirement to conduct Domestic Homicide Reviews, now Domestic Abuse Related Death Reviews
  • Modern Slavery Act 2015. Requires BCSP partners to respond to and safeguard our residents from trafficking and exploitation
